    আসসালামু আলাইকুম ওয়া রাহমাতুল্লাহ।
    ভাই, এক ভাই সুদী ব্যাঙ্কে চাকুরি করেন । উনি সাদাকা করতে আগ্রহী। উনার টাকা সাদাকা হিসেবে গণ্য হবে কি?
    এরই সাথে অন্যান্য হারাম কাজ করা ব্যক্তির টাকা সাদাকা হিসেবে গণ্য হওয়ার ব্যাপারে মতামত কি?
    জানালে উপক্ক্রিত হব।

    উনি উনার হালাল টাকা থেকে সদাকা করতে পারেন।সুদের টাকা থেকে নয়।
    অন্যান্য হারম কাজ করা বলতে কি বুঝিয়েছেন তা স্পষ্ট নয়।
    আর এই ধরনের মাসআলা জানার জন্য আপনার আশে পাশের দারুল ইফতা/ফাত্বওয়া বিভাগগুলোতে ফাত্বওয়া চাইতে পারেন ইনশাল্লাহ।
    কারন ফাত্বওয়া দেওয়ার যোগ্যতা সবার নেই। এটা যোগ্য আমানতদার আহলে হক মুফতিদের কাজ।

      তাই কোন ভাই সাদাকার দ্বার আল্রার নৈকট্য লাভ করতে চান তিনি যেন স্বীয় হালাল উপার্যিত সম্পদ দান করেন। তাহলেই তিনি আল্লাহর নৈকট্য লাভের আশা করতে পারেন।
      হা তবে যদি কারো নিকট কোন শরীয়ত পরিপন্থি পন্থায় সম্পদ হস্তগত হয় আর তিনি তাদের প্রকৃত হকদার সম্পর্কে অবগত থাকেন তাহলে তার নিকট তা ফিরিয়ে দেয়া। আর যদি হক্বদার সম্পর্কে তিনি না জানেন তাহলে সাওয়াবের নিয়ত ব্যতিত যাকাতের কোন খাতে ব্যয় করে দেওয়া। তাই কোন ভাইয়ের হাত যদি এধরনের কোন সম্পদ থাকে সাওয়াবের নিয়ত ব্যতিত সাদকা করতে পারবেন। এবং এগুরো মাসারেফে যাকাতের মধ্যে ব্যয় হবে।

            ব্যঙ্কের সবাই যদি কাফের হত তাহলে হানাফী মাঝাবের নিজস্ব একটা ফতোয়া আছে যার মাধ্যমে সুদ নেয়া যেত। তা হচ্ছে দারুল হরবে মুসলিম ও কাফেরের মধ্যে সুদ হয় না। কিন্তু এখানে সুদটা নেয়া হচ্ছে মুসলিমদের থেকে।

              প্রিয় ভাই,

              এই ব্যাপারে সবাইকে আরেকটু তাহকীক (হক্কানী আলেমদের কাছ থেকে) করার জন্য অনুরোধ জানাচ্ছি।

              আনসার আল ইসলাম ফোরামে এই ব্যাপারে একটি আলোচনা ছিল। সেটাতে দেখা গেছে, অনেক আলেম এটা অনুমতি দেন।

              কারণ এতে হাত বদল হবে। আর সুদের টাকা হারাম লি গাইরিহী। তাই হাত বদল হলে এটার হুকুম বদল হয়ে যায়। এটা আর অপবিত্র টাকা থাকে না।

              এতে ঐ ব্যক্তি এতে কোন সওয়াব পাবেন না। কিন্তু জিহাদী তানযীম এই টাকা নিতে পারবে। এই ব্যাপারে শাইখ সালেহ আল উসাইমিন (রঃ) এর একটি ফতোয়া আছে। খুজে পেলে এখনে শেয়ার করবো ইনশাআল্লাহ।

                The question has arisen due to many needy Muslims who are being thrown out of schools due to lack of tuition. There are many Muslims who have bank accounts which give interest, and they have not been using it as interest is haram. What should one do with the interest. Should he leave it to the bank or can it be used for such case as paying the tuition to the non Islamic institutions ?
                Please give valid reasons. This question is very important and urgent as the academic term has just started and funds are not available.

                I have received your question by e-mail concerning the legality of spending interest money for the benefit of needy students studying in educational institutions in your country. Herein, I will summarize the answer to your question according to what scholars have mentioned:

                If a Muslim has earned or received unlawful money, he should get rid of it. He must neither derive any personal benefit from it, such as spending this money in eating, drinking, housing, family expenditure, educational tuition, nor can he use it in averting hardship and acts of injustice as paying compulsory insurance fees, government or sales taxes, and customs and duty charges. Indeed, the intention of its removal must be the purification of one’s money from interest, and it is not considered alms giving because Allaah is pure and good and He, the Almighty, accepts only that which is pure and good.

                This interest money can be spent in many beneficial areas, such as for the poor and needy, for medication costs for needy people, helping mujaahideen and advocators of Islam, sustaining the impoverished and relieving debtors who can not repay their debts. Moreover, this money could be used in Islamic Center needs, such as constructing mosques, roads, etc… Thus, spending this money in the tuition of needy students studying in educational institutions falls within the aforementioned possible avenues of expenditure. This is permissible even if these institutions are supervised and directed by unbelievers, on condition that the subjects areas studied are Islamically permissible and do not result in any harmful or unlawful consequences. Moreover, this interest is considered forbidden and unlawful to the one who earns it, but as for the people to whom this money given, it is permissible and lawful to make use of it, for it is considered as lost money that no one owns.

                Finally, may Allaah grant us success in supporting Islam and Muslims.

                سؤالي هذا من أجل كثير من المسلمين المحتاجين الذين يُطردون من المدارس لعدم قدرتهم على دفع رسوم الدراسة . كثير منهم عنده حساب بنكيّ بفائدة ، ولكنهم لا يستخدمونها لأنها حرام .
                ماذا ينبغي أن يفعل أحدنا بهذه الفائدة ، هل يتركها للبنك أم يمكن استخدامها في هذه الحالة لدفع الرسوم للمعاهد غير الإسلامية ؟ أرجو إعطاء أدلة مقنعة .
                هذا السؤال مهم وعاجل حيث أن الفصل الأكاديمي بدأ و الرسوم غير متوفرة.

                فقد وصل سؤالكم المرسل بالبريد الألكتروني عن جواز صرف الأموال الربوية في نفقات الطلاب المحتاجين في المعاهد في بلدكم وجوابا على سؤالكم ألخّص لكم بعض ما ذكره أهل العلم في هذه المسألة :
                من كان عنده مال محرّم وجب أن يتخلّص منه بحيث لا ينتفع به المتخلّص لا في جلب مصلحة له كأكل أو شرب أو سكن أو نفقة أهل أو أجرة تدريس ولا في دفع مضرة أو ظلم عن نفسه كرسوم التأمين الإجباري أو سائر أنواع الضرائب والمكوس وتكون النية عند إخراجه تخلصا لا صدقة لأنّ الله طيب لا يقبل إلا طيبا .
                وأما المجال الذي تُصْرف فيه الأموال الربوية فيكون في سائر وجوه الخير مثل إعطائها للفقراء والمساكين ونفقات علاج المحتاجين وكذلك المجاهدين والغرماء من أصحاب الديون المعسرين وأنشطة المراكز الإسلامية وإصلاح المرافق العامة كدورات مياه المساجد والطرقات وما شابه ذلك.
                وصرفها في نفقات ورسوم تعليم الطلاب المحتاجين يدخل فيما سبق ولو كانت المعاهد تابعة للكفار ما دام حقل الدراسة مباحا ، ويكون المال المحرّم حراما على كاسبه وأما بالنسبة لمن أعطي له فيجوز أن يستفيد منه ويُعتبر كالمال الضائع الذي لا صاحب له .

                  I have a saving (NRE) account in Indian bank. Some interest money
                  deposited by bank. That money can give to poor (needy) people. It is
                  permissible ?

                  As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

                  Yes, dispose the interest money by giving it to the poor as Sadaqah without having the intention of reward.[1]

                  If a person has engaged in riba, then he has to repent to Allaah by giving up the sin, regretting what he has done, resolving not to go back to it, and getting rid of the haraam interest by spending it on charitable causes. He is not allowed to benefit from it himself or spend it on those on whom he is obliged to spend.

                  Shaykh ‘Abd al-‘Azeez ibn Baaz (may Allaah have mercy on him) said: With regard to the interest that the bank has given to you, do not give it back to the bank and do not consume it yourself; rather spend it on charitable causes, such as giving it to the poor, repairing public washrooms, and helping debtors who are unable to pay off their debts.                   Question:

                  I have received interest money from a savings account which I use for various purposes. I only use this account because the bank charges are negligible in comparison to opening an account purely for savings.

                  One advice I received is that you are not allowed to give the interest to anyone and it must be used to build toilets or pay fines/taxes. The other is that you can donate to a non-Muslim.

                  I have subsequently given the interest to a childrens hospital in another city without any intention for reward but fear of Allah’s punishment. The reason why I did this was that whenever I asked anyone if they had fines or taxes to pay they would say no.

                  As far as the hospital is concerned, the hospital name is The Childrens Hospital Trust and is managed by the Provincial Government of Western Cape. This is a referral hospital just for the children that have complexities and cannot afford the treatment. I get tax deduction certificates but do not use them at all when submitting my tax affairs.



                  Answer:

                  In the Name of Allah, the Most Gracious, the Most Merciful.

                  As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

                  The facilities of a conventional bank can only be used due to need and necessity. If you are putting your money into a savings account due to necessity, the interest money must be discharged off without the intention of attaining reward; instead you will be merely ridding yourself from wrongly-acquired money.

                  There is a difference of opinion amongst the contemporary scholars with regards to the disposal of interest money acquired from a bank:

                  1) The first opinion is that such interest money can only be given to those poor people who are eligible to receive Zakaat. It is necessary that the recipients are granted ownership and possession of the wealth. According to this opinion, it is not permissible to discharge interest money to public welfare projects, hospitals and the like thereof.[1]

                  2) The second contemporary opinion is that such interest money can be used in public utilities. According to this view, granting of ownership to the poor is not a requirement.[2]

                  The first view is more precautionary (ahwat) whereas the second view is more accommodating (awsa’).

                  As for giving the interest money to a non-Muslim, it is permissible to give it to them if they are poor. You may also forward interest money to a public utility directed by non-Muslims. Even then, giving it to the poor Muslims will be better as there are so many out there in the world.[3]

                  It will not be permissible for anyone to directly gain benefit from the interest money they advance. In addition to this, interest money cannot be used to pay off legitimate taxes or legitimate fines.[4]

                  It will not be permissible to give interest money to a masjid or for its construction. Likewise, it should not be given to Islamic institutions. [5]

                  After observing the background and nature of The Children’s Hospital Trust we understand:

                  100% of every donation you make to the Children’s Hospital Trust goes directly towards the Red Cross War Memorial Children’s Hospital or one of the projects aimed at improving the standard of pediatric healthcare in the Western Cape.

                  The Children’s Hospital Trust issues Section 18a tax certificates for all donations over R100 per annum, which are tax deductible for South Africans.

                  The Children’s Hospital Trust is an independent charity. The Children’s Hospital Trust operational costs are funded from an endowment, ensuring that 100% of all donations received go directly to the specified projects and programmes at the Hospital to benefit children. The same ethos will be applied for projects beyond the Hospital’s doors. Not a cent will be used for administration or operational expenses.[6]

                  It is a charitable organisation and a non-profit organisation (NPO). Its focus is centered around goals of a general philanthropic nature.

                  According to the accommodating view (awsa’), dispensing of interest money in such a hospital will be permissible. It is a welfare project without any financial gain.[7]

                    I have been confused on the issue of Masjids collecting interest money for distribution. Many people believe this money can be collected and donated for the use of toilets in a public place, but I have always been under the impression that this money is filthy and should be destroyed or buried. Is it permissible to collect interest money in the Masjid?

                    ANSWER

                    In the name of Allah, Most Compassionate, Most Merciful,

                    Interest transactions are totally unlawful (haram), thus whosoever deals with interest money in any way or form will be sinful. There are grave warnings promised in the Qur’an and Sunnah for the one who deals with interest.

                    Giving and taking interest are both decisively impermissible in Islam. Similarly, it is impermissible to consume unlawfully-earned money.

                    The ruling in the Hanafi School with regards to Haram and wrongly-acquired money is that the money must be returned to its owner(s). If it is not possible to return it to its owners, such as bank Interest, then one must give it away to the poor with the intention of removing the burden of this unlawful filthy money. (See: Radd al-Muhtar, al-Fatawa al-Hindiyya and Ahsan al-Fatawa)

                    Therefore, if the collection of interest money in the Masjid is distributed on poor people, then this is permissible, otherwise impermissible.

                    It should also be remembered here that, this ruling is in the situation when one already has interest money in their ownership. To actually open up an interest bearing account for the purpose of distributing interest money on poor people, will be unlawful.

                    The basis of the Hanafi position is that wrongly-acquired money must be returned to its owner(s). If it is not possible to return it to its owners, such as bank interest, the fuqaha mention that one must give it away to the poor (or to charities in general, according to some), though with the intention of clearing one’s dues of wrongly-acquired money. This is mentioned by Ibn Abidin in his Hashiya, in the Fatawa al-Hindiyya, and in contemporary references such as Ahsan al-Fatawa.
